This agreement regulates the use of pictures purchased from bergbild.net for private and commercial use. Different or more extensive forms of use can be arranged with bergbild.net.

1) Basic Licence („L“)
You purchase the unlimited, non-exclusive and non-transferable right, to use a picture purchased for any kind of private, non-commercial use, to reproduce, publish, change and handle it. All kinds of commercial use are excluded. Any kind of use in social media (Facebook) and any other kind of use that might lead to conveying rights to a third party are also excluded. It is your personal right to use the picture and it is yours only. The copyright is reserved to bergbild.net. Any violation of this agreement will be treated as an infringement of copyright.

1b) Extended Licence („XL“)
You purchase the unlimited, non-exclusive and non-transferable right, to use a picture purchased for any kind of use, to reproduce, publish, change and handle it. Only yourself and if necessary your staff members are allowed to use the picture. You are entitled to use the picture on up to three work stations and to make a back-up copy. The following forms of use are excluded:

• Any kinds of use conveying rights to third parties, this is also relevant to the use in social media (Facebook et al.)
• Any kind of use of the picture for drafts that are meant for sales and distribution, be it in digital or non-digital form (e.g. website,- design- or flash Templates); furthermore for goods whose value is originating from the picture purchased here (e.g. postcards, posters, calendars)
• Any kind of use for products on demand (e.g. postcards, posters, calendars)
• Any kind of purchasing the licence to a third party.
• The copyright is reserved to bergbild.net. Any violation of this agreement will be treated as an infringement of copyright.

2. Exclusion of warranty and liability
Pictures are purchased “as they are” without any kind of guarantee; including the implicit guarantee of quality or the warranty of fitness for a particular use. bergbild.net is not responsible for any claims under public law that may be resulting from the use of a picture purchased here.
